Defacto partners and spouses of Australian citizens and permanent residents are eligible to apply for permanent visas to reside in Australia.
Applications can be made inside or outside Australia.
The assessment is a two-stage process. You are first assessed for a temporary visa. If you are outside Australia this visa will allow you to travel to Australia. If you are inside Australia, it will allow you to remain in Australia.
After a minimum of two years from the time of application your application will then be assessed for the Permanent Visa.
Prospective Marriage Visa
This is a temporary visa that you must apply for from outside Australia.
This visa allows the holder to come to Australia for the purpose of marrying their Australian fiancé.
Once the marriage has taken place, the applicant then applies for the two-stage partner visa from within Australia.
Australia has a variety of options for people to bring their parents to Australia.
People are available to apply for Parent and Aged Parent subclasses 103 and 804 which are relatively inexpensive but are subject to extremely long processing times (currently in excess of 20 years).
Contributory Parent visas are a faster way for parents of Australian citizens and permanent residents to get permanent residency in Australia but have a substantial Visa Application Charge
Sponsored Parent Visas are visas that allow for Australian children to sponsor their parents to remain in Australia for up to five years. In some circumstances, applicants can get a subsequent visa which can allow for a total residence of ten years in Australia. There is no permanent resident pathway with the Sponsored Parent visa option.
Permanent Child Visas (which also include Orphan Relative and Adoption Visas) may be available to overseas children of Australian citizens or permanent residents. Applicants may be inside or outside Australia when they apply.
Parents who are present in Australia on temporary visas may, in some circumstances, apply for their overseas based dependent children to join them in Australia with a 445 Dependent child visa.
These are for people who have no living relatives except for people living in Australia. Applicants can be inside or outside Australia when they apply.
Current processing times for these visas is in excess of 15 years so, for this reason, we will only assist with applicants outside Australia in exceptional circumstances.
Applicants inside Australia will be issued Bridging visas to allow them to remain.
Let’s make the process smoother, clearer, and less stressful, together.
